Defense in freeway-shootings case seeks to depose Gov. Ducey

PHOENIX (AP) – Attorneys defending a man accused of some of the metro Phoenix freeway shootings this summer are looking to ask Gov. Doug Ducey about his twitter.

Attorneys for Leslie Allen Merritt Jr. filed a motion Wednesday to depose Ducey, citing a tweet the governor sent minutes after their client was taken into custody. The tweet read, “We got him!”

According to court documents, Merritt’s attorneys want to know what information Ducey had before their client’s arrest that made him confident enough to hit send.

A Ducey spokesman says the motion appears to be a publicity stunt and that the governor has nothing of relevance to add to his fair trial.

The judge in Merritt’s case has issued a gag order preventing the defense and prosecution from talking about the case publicly.
