Sentencing set back for man charged in fatal crash

Markley Allen Foster was scheduled for sentencing at the Yuma County Superior Courthouse this morning. However, the judge says a motion has been filed for a new trial.

Foster’s attorney, Michael Donovan, has also filed a motion for a psychiatric evaluation. The judge is requiring the evaluation before moving on with sentencing at this time.

Foster was found guilty of two counts of second degree murder, one count criminal damage, possession of marijuana, and possession of drug paraphernalia in November 2015. He was involved in a car accident that killed a couple from San Luis, Arizona.

The mitigation hearing is set for January 20th.
